By accessing or using the OEA Gift Exchange platform operated by Operational Excellence Advisors ("OEA", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. These terms apply to all visitors, users, buyers, and sellers on the platform.
OEA Gift Exchange is a peer-to-peer marketplace that facilitates the buying and selling of discounted gift cards. OEA acts as an intermediary and escrow agent between buyers and sellers. We do not own, issue, or guarantee the gift cards listed on our platform beyond our stated buyer protection guarantee.
All purchases on OEA Gift Exchange are protected by our escrow-backed buyer guarantee. Funds are held in escrow until the buyer explicitly confirms that the gift card is valid and working. Buyers have 72 hours after receiving card details to confirm or dispute the transaction. If a dispute is raised, OEA will investigate and issue a refund if the card is found to be invalid, already used, or misrepresented.
To list gift cards on OEA Gift Exchange, sellers must: (a) complete identity verification with a valid government-issued ID; (b) provide accurate card details including the true face value and current balance; (c) submit proof of ownership for each card listed; (d) agree to the hold period before receiving payouts. Sellers who submit fraudulent, stolen, or misrepresented cards will be permanently banned and may be reported to law enforcement.
Seller payouts are held in escrow until the buyer confirms the gift card is valid. The hold period is a minimum of 72 hours from card delivery. OEA charges a platform fee of 10% on each completed sale. Payouts are processed within 3–5 business days after buyer confirmation. OEA reserves the right to extend the hold period for high-risk transactions or during dispute resolution.
Users may not: (a) list stolen, counterfeit, or fraudulently obtained gift cards; (b) create multiple accounts to circumvent platform restrictions; (c) attempt to manipulate card balances or misrepresent card details; (d) use the platform for money laundering or any illegal financial activity; (e) harass, threaten, or defraud other users. Violations will result in immediate account termination and potential legal action.
OEA Points are earned on qualifying purchases at a rate of 1 point per $1 spent. Points can be redeemed for discounts on future purchases at a rate of 100 points = $1. OEA Points have no cash value and cannot be transferred, sold, or exchanged. OEA reserves the right to modify, suspend, or terminate the loyalty program at any time with 30 days notice.
OEA's liability is limited to the transaction amount for any given order. We are not liable for any indirect, incidental, or consequential damages arising from the use of our platform. Our total liability shall not exceed the greater of $100 or the amount paid for the specific transaction giving rise to the claim.
Your use of OEA Gift Exchange is also governed by our Privacy Policy. We collect and process personal data as described therein, including identity verification documents which are stored securely and used solely for fraud prevention and compliance purposes.
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.
